CONDITIONS OF USE

The use of this website will be governed by these conditions, including the content and services made available to users. IMPULSO therefore asks you to read these conditions carefully, as they contain all the information related to your rights and obligations.

By accessing the website you will be considered as a user thereof and do thereby expressly, automatically and voluntarily accept the conditions in force at all times. Should you not wish to accept them, you are advised not to continue using the website. Note that access to www.impulso.es is free and does not require prior subscription or registration.

IMPULSO reserves the sole right to review the current conditions at any time in order to introduce modifications derived from legislative changes or by corporate decision as part of its commitment to publishing and informing users regarding the variations that may affect them. These modifications will be understood to have been accepted when the user continues to use the site.

At any time and without prior notice, IMPULSO also reserves the right to unilaterally modify the structure and design of the website, as well as the services it offers or its content. Under these same terms, during such modification, repair, update or improvements, site access may be suspended.

As a result of these modifications to the site, new content or services may be included that, apart from being subject to these conditions of use, is also subject to special conditions that extend or substitute current ones. In the event of any discrepancy between general and special conditions, the stipulations of the latter shall prevail.

Obligations and responsibilities of users

During use of this website, the user undertakes not to contravene current legislation, good faith, generally accepted usage and public order, it being forbidden to use the site for illicit, deceptive, malicious purposes or those which may be injurious to IMPULSO and third parties. Usage must therefore be appropriate and correct, with the user abstaining from behaviour that might be harmful to IMPULSO’s image, interests and/or rights and/or those of third parties or which may damage, disable or overload the site. Users should also refrain from accessing, using and/or manipulating IMPULSO’s data.

The user undertakes to provide truthful information through communications with IMPULSO. They shall be solely responsible for the damage that may be caused by any inaccurate or false information, both to IMPULSO and to third parties.

IMPULSO adopts adequate security measures to detect the existence of viruses. However, it should be taken into account that computer system security measures are not entirely reliable, meaning that IMPULSO cannot guarantee the absence of viruses or other elements that could affect the user’s computer systems, documents and/or files. We ask that users refrain from introducing or spreading computer viruses or physical or logical systems that could cause damage to IMPULSO or third parties.

IMPULSO reserves the right to take the necessary legal action in defence of its interests or temporarily suspend site access without prior notice due to maintenance, repair, updating or improvement operations.

Intellectual and industrial property. Admission of backlinks and hyperlinks

Permission to reproduce photographs

The content, photographs, videos, designs, texts, graphics, logos, icons, buttons, software, trade names, trademarks or any other sign that may be susceptible to commercialisation or industrial use shown on the website are the property of IMPULSO, or of third holders that have duly authorised their inclusion on the site or on any social media on which IMPULSO is present. An exception to the foregoing is those cases where there is an express indication to the contrary and are protected by domestic and international regulations governing intellectual and industrial ownership, among other legislation.

The reproduction of this website, as well as any of its content, is forbidden unless expressly authorised in writing by IMPULSO. Notwithstanding the foregoing, the user will have the right to create links to the website for private and non-commercial use subject to certain conditions, reserving the right to request at any time the immediate elimination of any such link. These conditions are:

    • It is a revocable and non-exclusive right.
    • Users may not imply that IMPULSO recommends the website, services or products in question or distort their relationship with IMPULSO.
    • It may not include content that is illegal or contrary to public order, which can be considered to be in bad taste, obscene, controversial or offensive, or that incites violence or discrimination based on sex, race or religion.
    • The link must direct users to the website, without allowing its reproduction as part of the initial site, within one of its frames or create a browser on any of the pages thereof.

IMPULSO has no control over the information, content, products or services provided by other websites that have established links to the website. For this reason, it cannot be held responsible for any aspect related to such sites.

IMPULSO is a registered trademark. Its reproduction, imitation, use or insertion of these trademarks without the company’s due authorisation is prohibited.

Company responsibility

IMPULSO is not responsible for the service deficiencies of its service provider or communication networks, or the problems resulting from the malfunction or use of non-optimised versions of any type of browser, as well as those derived from prolonged interruptions to the power supply, telecommunications lines, social conflicts, strikes, explosions, floods, acts and Government omissions or any case of force majeure or unforeseeable circumstance.

Both access to the website and the use that may be made of the information contained therein is the exclusive responsibility of the person who undertakes it. IMPULSO cannot therefore be held liable for the consequences that may result from such use of or access to information. It may only be held responsible for the elimination as soon as possible of the content that may generate any type of damage or harm, provided that it is notified to its existence or have effective knowledge thereof.

IMPULSO shall not be liable for possible security errors that may occur or any possible damage to the user’s computer system, files or documents stored therein, where these stem from a virus originating from the user’s computer, the malfunctioning of the browser or the use of non-updated versions thereof, telephone faults, interferences, omissions or disconnections in the operational functioning of the electronic system motivated by causes beyond IMPULSO’s control.

Rules of use regarding the Blog tab

In the News section, the blog offers information concerning company news, services offered, matters of interest and any IMPULSO-related general information. The current website does not allow users to participate with their comments in the posts published by IMPULSO in the Blog section.

IMPULSO recommends that users carefully read these specific conditions if they intend to participate at their own risk. It shall be understood that these rules have been accepted in their entirety by users through their use of the Blog. Should a user not agree with these rules, they are advised not to participate.

Conflict resolution. APPLICABLE LAW AND JURISDICTION

These General Conditions of Use shall be governed by Spanish legislation and, in particular, by applicable law regarding the protection of personal data (the Personal Data Protection Act – Organic Law 15/1999 and the European Union General Data Protection Regulation 2016/679) and the legislation regarding of the information society services (the Information Society Services and eCommerce Act nº 34/2002 of 11 July 2002). Any dispute will be resolved before the Courts of Oviedo.
